Objective Evidence Matters: A Voluntary Dismissal with Prejudice.
Another favorable outcome demonstrating the value of a thorough investigation and early case evaluation.
After serving an OPRA request upon the appropriate police department, we obtained and carefully reviewed the responding police officer’s body-worn camera footage and dash camera video in a dog bite lawsuit. The reviewed evidence established that our client was not involved in the incident. The footage further confirmed that the incident occurred at a location different from the location first report.
Following the production and review of this objective evidence, the claims against our client were voluntarily dismissed with prejudice.
This result underscores the importance of obtaining and analyzing all available evidence before liability assumptions become entrenched. In an era where body-worn cameras and dash cameras frequently capture critical facts, these recordings can provide an accurate, unbiased account that fundamentally changes the course of litigation.
