Harwood Lloyd achieved a victory in the Appellate Division
Harwood Lloyd recently prevailed in the Appellate Division, which affirmed the trial court’s decision to dismiss the appeal of a land use approval for a new mixed-use development granted by the Garfield Planning Board in 2023. Allyson M. Kasetta represented the developer in connection with the initial approval, creating the record upon which the courts would ultimately rely in evaluating the propriety of the Planning Board’s actions. She then successfully persuaded the Appellate Division that the appellant could not meet its burden of demonstrating that the Planning Board’s decision was arbitrary, capricious, or unreasonable, finally allowing the development project to proceed after significant delays.
