The Honorable James J. DeLuca, J.S.C. (Ret.) and David Repetto, co-managing of Harwood Lloyd, LLC, recently made a presentation New Jersey Chapter of the National Academy of Elder Law Attorneys regarding the mediation of probate matters including guardianship proceedings. The presentation to more than 25 Chapter members covered a wide range of topics including why probate matters are appropriate for mediation, when such mediation should occur and what lawyers should do to prepare themselves and their clients for mediation.
Judge DeLuca is Counsel to Harwood Lloyd, LLC and focuses his practice on the resolution of commercial, probate, trust and estate disputes through mediation and arbitration as an alternative to traditional litigation. Judge DeLuca was appointed to the Superior Court of New Jersey in February 2015. He initially served in the Civil Division; and in July of 2018, he was reassigned to the Chancery Division where he served until his retirement in December 2022. While in the Chancery Division, Judge DeLuca handled all matters appropriate for the Chancery Division including Probate and Guardianship matters. Prior to his appointment to the bench, Judge DeLuca was in private practice for more than 37 years.
Mr. Repetto has been with HL for more than 33 years and practices primarily in HL’s Wills, Trusts, and Estates Department, concentrating on probate litigation. Mr. Repetto is regularly appointed by the court to serve as a mediator in various probate disputes, including guardianship matters. He is frequently called upon to serve as court appointed counsel and guardian ad litem for alleged incapacitated persons.
